These general conditions are part of the vehicle rental contract that takes place between Joly Motor S.L., (henceforth, the lessor) and the customer (henceforth, the lessee). Additional agreements or that differ from those specified here are reserved as long as they are made in writing.
1. Minimum age and age of driving license.
The minimum age to rent a vehicle is 28 years. Likewise, the driver’s license must be at least three years old.
2. Rent
a) The object of the contract for the lessee is only the temporary assignment of the reserved vehicle. The vehicles are authorized as rental vehicles without a driver.
b) All rates include 300 kilometers per day, as specified on the website. the price for each additional kilometer includes civil liability insurance as well as comprehensive insurance with a deductible specified on our website and invoice, . Fuel expenses are not included.
c) The amount of the all-risk insurance deductible must be paid in cash or by credit card (Euro/Mastercard , VISA, American Express will not be accepted) as a guarantee for the vehicle, it must be delivered d) In case of return of the vehicle before the stipulated term, the amount agreed in the contract must also be paid in its entirety.
3. Obligations of the lessee
The lessee has the obligation to treat the vehicle with care and due diligence, he must pay particular attention to the technical regulations, the instructions for handling and guarantee road safety at all times. The renter must regularly check the oil, water and tire pressure. The lessee must adhere to the legal traffic regulations. He is responsible for administrative payments, fines and penalties that originate in the use of the vehicle.
The tenant is expressly prohibited from:
a) allow the use of the vehicle to drivers other than those authorized in the contract
b) allow the driving of the vehicle to an authorized driver if this driver’s license has been withdrawn, if you do not have a valid license or if he was not fit to drive.
c) use the vehicle in the event that his license had been withdrawn or if he was not in possession of a valid license.</ span>
d) use the vehicle if it was not in a condition to be used.
e) take part in any sporting event (races, contests, shows) or use the vehicle for the respective trainings; use it off paved roads or on beaches.
f) manipulate the odometer. Any breakdown of the same must be communicated immediately to the lessor.
g) mortgage, sell or otherwise dispose of the vehicle, its components, equipment, accessories and documents in such a way that the lessor sees harmed to his right of ownership or any other right that corresponds to him.
h) park the vehicle in conditions that protect it against possible theft.
4. Obligations and responsibilities of the lessor.
The lessor delivers the vehicle in perfect condition, clean, working, in a roadworthy condition. The lessee also receives the vehicle’s papers. Damages will only be assumed by the lessor when they have been specified in writing in the contract during delivery. If, during the contracted period, it is necessary to carry out any repairs to ensure the correct operation or road safety of the vehicle and, provided that the damage was not caused by the lessee, the lessee may commission an official workshop of the manufacturer up to a maximum amount of €100.00, having to deliver to the lessor the original invoices corresponding to the repairs. If the costs of the repair exceed €100.00, prior authorization must be requested from the lessor before commissioning these repairs. Tire damage must be borne by the renter. Regardless of the legal reasons, the lessee has no additional rights unless the damage suffered was caused intentionally or due to gross negligence on the part of the lessor. If a transport vehicle is rented and the activity to be carried out is a public service, the company or self-employed person who rents it will be obliged to request a transport card for the rented vehicle. Failure to comply with the aforementioned obligation will make the lessee liable for any penalty or fine.
5. Tenant’s liability for damages.
The lessee is responsible from the moment the vehicle is delivered to him until he returns it for all damages suffered by it (also in cases of slight negligence ) such as accidents, malfunctions, damage due to improper handling or diminishing the value of the object (including if it goes missing or if it is confiscated) that takes place beyond the normal wear and tear of the vehicle during the rental period . In the event that the vehicle subject to the contract suffers damage, the lessee would be responsible for the costs of repair, recovery, repatriation, decrease in technical and economic value and the impossibility of renting the vehicle during the time of repair or, in the event of total loss, until it is replaced. This within a margin of expenses that actually take place or that are certified by corresponding expertise. If the vehicle cannot be rented, a daily fee corresponding to one day’s rental must be paid. The tenant will have the right to prove that the damage was less. The renter is also responsible for the accessories he has rented additionally.
6. Action in case of accident or damage.
In the case of any damage, also in the case of damage and accidents in which third parties are not involved, the lessee is obliged to communicate the events immediately by phone to the lessor. Towing and/or repair services can only be requested with the prior authorization of the Landlord. In the event of an accident, the lessee is obliged to make a friendly statement of the accident and to communicate it to the lessor within a period not exceeding 24 hours. If there are difficulties in determining guilt, please call the COMPETENT AUTHORITIES (091) or EMERGENCY (112) to clarify the facts. The renter will be responsible for any accident or improper use on the days when the vehicle is immobilized, as long as he is to blame for what has happened. In any accident you must contact the police. It is necessary to collect evidence, write down the data of those involved as well as do everything that can contribute to the correct and complete clarification of the incident.
7. Sure
a) The vehicle has comprehensive civil liability insurance that covers damage caused to people, things or property.
b) The vehicle rented by the lessor is insured against damage, theft and fire. The renter must leave a deposit for the amount specified on the invoice and website paid in cash or by credit card at the time of receiving the vehicle. This amount will be returned in full as soon as the motorcycle has been delivered to the lessor without any damage. Each damage suffered by the vehicle will be deducted from the amount of the deposit in accordance with the amount that corresponds to the lessee. The tenant is explicitly reminded again that despite having comprehensive insurance he will have to answer for the damages caused in the following cases if he or the person listed with him in the contract:
c) did not meet the obligations detailed in section 4.
d) if, being responsible for the same, he left the scene of the accident.
f) if it causes damage intentionally or with gross negligence.
g) if the rental term is exceeded contrary to what is stipulated in the contract.
8. Return of the vehicle The renter must return the vehicle at the end of the term to the site , the stipulated date and time together with all the vehicle papers, it will be returned with the petrol tank full, clean, in perfect condition, without defects, the keys, tools and accessories, all this in the same good condition in qwhen you received it If these conditions are not met, the following surcharges would apply:
If there is no gasoline, the amount of filling the tank will be charged, plus 15 euros for the service.
The landlord may terminate the rental agreement without prior notice if there is an important reason that makes the continuation of the agreement unreasonable. Important reasons will be considered especially if the lessee has indicated incorrect information regarding his person, his creditworthiness or if he has seriously breached contractual obligations. In case of cancellation of the contract, the vehicle subject to the same must be returned immediately even before the expiry of the stipulated period. The lessor’s compensation rights are not affected.
General commercial conditions.
These general commercial conditions are the basis of the rental contract between Joly Motor S.L. (hereinafter, the lessor) and the lessee. They concern the rental of vehicles
1. Hiring.
The lessee can reserve the desired vehicle both in person and online at < a style=”color: #32503a;” href=”http://www.mediterraneanroutes.com”>www.mediterraneanroutes.com and www.jolyrent.com. You will then receive an e-mail from the landlord with a confirmation of the reservation.
RESERVATION AND PAYMENT All reservations require a valid VISA or Mastercard credit card with sufficient credit. After confirmation of the service, the credit card provided will be charged the amount agreed and known by both parties. .
GUARANTEE OF AVAILABILITY After payment of the reservation, the renter will receive a confirmation by email. This is the guarantee of availability of the reserved motorcycle. Joly Motor S.L. reserves the right to replace the vehicle chosen for the rental at any time, as long as it is due to circumstances that could not be foreseen. Joly Motor S.L. will try to ensure that the lessee will drive the vehicle that has been confirmed to him. Unfortunately, sometimes some unpredictable and uncontrollable situations occur. This includes, but is not limited to, mechanical breakdowns, collision damage, and theft. If Joly Motor S.L. was not able to replace the confirmed vehicle with an equal or similar one, the customer will be reimbursed the amount that differentiates the service. This constitutes the maximum responsibility of Joly Motor S.L. Even if the vehicle is returned by the lessee before the rental period has ended, the total amount agreed in the contract will be charged.
2. Cancellations
A) If the cancellation by the tenant is made between 30 and 15 days, 50% of the total rental payment will be refunded. If it is done less than 15 days in advance, no refund will be made.
B) If the cancellation of the contract by the lessor If for reasons that escape the sphere of influence of lessor (force majeure, strikes, terrorist attacks, catastrophes, etc.) it is necessary to cancel an already confirmed reservation, the full amount of the payments already made will be returned to the lessee. No further responsibilities can be demanded. In addition, the lessor can cancel the contract immediately if one or more of the obligations specified in the clauses were not fulfilled by the lessee or if he acted against them. Consequently, the vehicle subject to the contract will be placed in a safe place and there will be no refund of the amounts paid for the lease.
3. Attention to regulations
The lessee is responsible for complying with the respective traffic rules. Each renter assumes his own risk when driving and is responsible within the framework of legal civil liability for damages that may be caused by those traveling with him or other road users.
4. Passport, Visa, health regulations and driving license
The lessee is himself responsible for complying with current Spanish or regional regulations in relation to passport, Visa, health and driving license as well as for refers to the attention to road rules. If the lessee could not take the reserved vehicle or had to return it early for not having taken these regulations into account, the lessor would be free of all responsibility and would not have the obligation to return the amounts have paid.
5. Responsibility

6. Claims

Mileage is unlimited for rentals of 7 days or more. In case of rentals from 1 to 6 days there will be a limit of kilometers of 300 per day. The price of the additional KM is €0.20 per kilometer.
You can pick up the motorbike at our office located in Sant Joan d’Alacant, or we’ll take it to your home or hotel. This delivery point must be communicated in advance. In addition, we have the possibility of collection, from the riders in the MiniVan to the delivery point of the motorbikes, prices depend on the collection point.

If your collection time is in the morning, Mediterranean Routes allows you to collect the motorbike the day before in the afternoon for FREE (as long as it is not a holiday). The same goes for the return, if your return is scheduled for 6 p.m. you can return it the following day between 9 and 10 am for FREE. If the motorcycle is returned later than 10:30, it will be counted as an additional day of rental.
